Digital Millennium Copyright Act (DMCA) Notice and Takedown Policy

Notification of Copyright Infringement

  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Counter-Notification

If you believe that your material that has been removed or to which access has been disabled is not infringing, or that you have authorization from the copyright owner, the copyright owner’s agent, or under the law, to post and use the material, you may send a counter-notification to our Copyright Agent. Your counter-notification must include the following information:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
  2. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
  3. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in [Your Jurisdiction], and a statement that you will accept service of process from the person who provided the DMCA Notice or their agent.

Please send the counter-notification to our designated Copyright Agent at the address provided above.

Repeat Infringers

Magfen may, in appropriate circumstances, terminate the accounts of users who are repeat infringers.
